Metro-North union says bosses lied about crowded trains dispute
Metro-North Railroad's conductors and engineers say the railroad lied after their dispute over crowded trains went public.
They say the railroad brass lied in order to deflect attention from the need to return the railroad to a pre-pandemic schedule.
In a letter to Metro-North President Catherine Rinaldi, the leadership of the Association of Commuter Rail Employees says the railroad should retract a statement to The Journal News Monday suggesting their disagreement had to do with worker overtime pay.
Ask Emily: How to reduce overtime hours
Q. Paying employees overtime can become a huge financial burden for veterinary practices, so devising an overtime strategy at your practice should be a priority. Managing overtime, however, requires a joint effort between managers and team members. But what does that look like exactly?
Quite a lot has been going on:
Panera franchisee must pay $4.6M to settle overtime suit
The country's largest Panera Bread franchisee, Covelli Enterprises, must pay $4.6 million to settle a class-action case involving overtime pay, according to a deal that received final judicial approval late last week.
The lawsuit dates back to January 2018 when a group of Panera assistant managers in Ohio filed suit against the operator claiming that they were being forced to work without overtime pay after being wrongly classified as exempt from overtime protections.
DOL Clarifies Requirements for Overtime Pay in Fluctuating Workweeks | Smith Anderson - JDSupra
The federal Department of Labor (DOL) has issued a final rule that will revise a Fair Labor Standards Act regulation to clarify that an employer may provide bonuses, premium pay, and hazard pay to non-exempt employees when using the fluctuating workweek method of overtime calculation.
Generally, an employee who is not exempt from receiving overtime under the FLSA is entitled to overtime pay at a rate equal to 1 ½ times their “regular rate” of pay for each hour worked over 40 hours per week.
Case: Wage & Hour/Overtime Calculation (S.D.N.Y.)
Nearly 20 Department of Homeless Services drivers for New York City are entitled to summary judgment on their claims that city didn't properly calculate their rate of overtime compensation when it failed to include night shift differentials and meal allowance payments in the base rate of pay, and only compensated the drivers at a straight rate when they elected to receive compensatory time instead of cash.
Bimbo Bakeries Hit With New Overtime, Benefits Suit by Drivers
Bimbo Bakeries USA Inc. misclassified drivers as independent contractors rather than employees, depriving them of overtime pay and benefits, a suit filed Wednesday in federal court in Vermont alleges.
The drivers routinely work more than 40 hours per week, but aren't paid time-and-a-half overtime for the additional hours, the plaintiffs say.
The company also unlawfully requires them to bear its business expenses by deducting from their paychecks for use of the company's electronic equipment, lost or stolen product, and other expenses, the complaint alleges.
