DES MOINES, Iowa — Local 5 has learned that the Des Moines Police Department racked in a total of $252,269 in overtime in ten days during the protests.
Sgt. Parizek with the Des Moines PD says the city has a budget and every department has a budget made for overtime.
"We're looking at a quarter of a million dollars and the only time we ever get close to that is during the Iowa State Fair," explains Sgt. Parizek. "So, you look at the resources that were devoted in 4 days versus 12 days at the Iowa State Fair it gives you a really good idea of just how many officers were out here. It really was an all hands on deck type of situation."

Overtime News: Department of Labor Issues Final Rule on Fluctuating Workweek - Lexology
On May 20, 2020, the U.S. Department of Labor (“DOL”) issued its final rule related to the fluctuating workweek (“FWW”) method of overtime. This method of calculating overtime has in the past been referred to as the “Fixed Salary for Fluctuating Hours” method. This allows employers to pay overtime at one-half of the employee’s regular rate, rather than time-and-one-half.
Let’s take a look at the concept behind the FWW method of compensation. A non-exempt, i.e., overtime eligible, employee is paid on a salary basis. This salary is fixed and paid every week regardless of the quality or quantity of work performed. The employee is paid that salary week-in-and-week-out regardless of whether the hours worked are few or many.
SC Auto Body Shop Pays $21,874 in Back Wages and Damages for Overtime Violations
After an investigation by the U.S. Department of Labor's Wage and Hour Division (WHD), Coastal Collision & Glass Inc. , an automotive body repair shop based in Surfside Beach, SC, has paid $21,874 in back wages and liquidated damages to six employees to resolve overtime violations of the Fair Labor Standards Act (FLSA.)
WHD investigators determined Coastal Collision & Glass Inc. failed to pay employees overtime when they worked more than 40 hours in a work week, instead paying straight time rates for all hours worked. The employer also failed to keep accurate records of hours worked for one employee.

Los Angeles police officers working around the clock to quell ongoing protests will not be paid for working overtime, Breitbart News reports.
According to an internal letter obtained by Breitbart, the department’s overtime has cost more than $40 million.
Police Chief Michael Moore states that the overtime costs “far exceeds any budgetary reserve to address unusual occurrences.”
In the letter, Moore described the past several days as “extraordinary” but didn’t specifically name the Floyd protests that have been taking place.

Philadelphia Police Commissioner Danielle Outlaw said Wednesday she plans to cut overtime to help offset Mayor Jim Kenney's abrupt decision to drop his proposal to add $19 million to the force's budget.
During a three-hour budget hearing before City Council, Outlaw said the savings would be used to outfit more officers with body-worn cameras, hire more criminal intelligence analysts, and conduct implicit-bias training, among other initiatives.

"We expect to pay for these programs by decreasing our police overtime by comparable amounts," said Outlaw, who became the city's top cop in February.
Fluctuating Workweek: DOL WHD Finalizes Revised Methodology
Before doing so, it is important to summarize the fluctuating workweek methodology. Section 778.114 was originally published in 1968. It implemented a Supreme Court of the United States ruling in a 1940 case in which an employer had paid a nonexempt employee a fixed weekly salary for working a workweek of irregular or fluctuating hours of work.

Thus, in its final rule, the WHD specifically enumerated the following five conditions that must be met in order for an employer to be able to use the fluctuating workweek methodology to pay overtime compensation.
