"I don't necessarily believe this was an error," said another assistant who asked not be identified. "I just think they didn't expect any blowback."
By Tuesday, afternoon, however, CBS human resources executive Ellen Goldsmith sought to "correct" and "clarify" the earlier communications. Goldsmith said there were, in fact, no such plans to limit or cap the hours to 40 hours per week for assistants working for producers.
"We are continuing to require written pre-approval for any hours worked in excess of 52 hours per week," Goldsmith wrote. She added that workers would be paid in accordance with California law and "there has been no instruction or intention to reduce your pay for hours worked retroactively."

5th Cir. upholds jury verdict awarding Texas police lieutenants overtime | HR Dive
Misclassification of employees under the FLSA is a common issue, especially as it pertains to overtime pay, and it can lead to costly litigation. The law requires that workers be paid at least the minimum wage and overtime for all hours worked over 40 in a workweek unless an exemption applies.
To determine whether workers are exempt, employers should consider both salaries and job duties, sources previously told HR Dive . If employers want to avoid paying overtime, workers must meet two basic tests — salary basis and job duties. All of the exemptions except the outside sales exemption require employees to make more than $684 per week. Once the salary threshold is met, the employee's job duties are considered. The required job duties vary, depending on the exemption.

Do Referral, Longevity Bonuses Affect Overtime Pay? It Depends
Paying workers a reward for their longevity or for referring a new hire to the company will sometimes mean companies also need to fork over more overtime pay, the Labor Department said in a series of opinion letters.
The DOL Wage and Hour Division issued three opinion letters Thursday, all clarifying the agency's interpretation of whether various forms of boosts to a worker's salary should be included in the "regular rate" of pay. That refers to the typical hourly rate, which is then multiplied by 1.5 to calculate the overtime premium paid to many workers for hours beyond 40 in...
Maine trade groups lash out against proposed increase in overtime pay eligibility - Portland
A broad coalition of business groups is marshaling opposition to a bill that would extend overtime eligibility to thousands of additional salaried workers in Maine.
