HARRISBURG, Pa. — A Central Pennsylvania eatery with locations in Chambersburg, Waynesboro, and Gettysburg is the target of a probe by federal investigators, who claim it shorted employees on minimum wage and refused to pay overtime.
The claims are part of a complaint filed in U.S. Middle District Court by The U.S. Department of Labor against Montezuma of Pennsylvania, Inc., a restaurant chain specializing in Mexican fare.
Federal investigators say the restaurant company did not pay tipped employees like bussers and servers the require minimum wage between September 2016 and September 2019.

It's Springtime for Wage and Hour Rights: Worker-Friendly Changes to Wage & Overtime
In the midst of growing alarm over the coronavirus pandemic and an almost all-consuming focus on public health, workplace and legal developments related to the pandemic, many Colorado employers may have missed the significant changes in Colorado wage and hour laws recently ushered in by the Colorado Department of Labor and Employment (CDLE). These changes are contained in the March 16, 2020 Colorado Overtime and Minimum Pay Standards Order #36 (“COMPS”) Order #36.
Harvard announces salary and hiring freeze due to coronavirus
Harvard University is implementing an immediate hiring and salary freeze, canceling or deferring discretionary spending and delaying some capital projects due to financial effects of the Covid-19 pandemic.
The university said the hiring and salary freeze is for "exempt employees" — those who are typically nonunion members and are not eligible for overtime pay under the Fair Labor Standards Act.
Bacow, Lapp, and Garber are taking 25% salary cuts. Senior school administrators, including deans, vice presidents and vice provosts, are also reducing their salaries to contribute to a support fund for employees experiencing financial hardships.

Employee Misclassification and Wage and Hour Claims
The federal Fair Labor Standards Act (FLSA) provides the legal requirements for minimum wage and overtime pay, among other worker rights. A violation of the Act could give rise to a wage and hour claim, which could negatively affect a business.
However, not all workers in Connecticut and nationwide are protected by the FLSA. Ultimately, whether a worker is covered by the Act depends on whether the worker is an exempt employee or a nonexempt employee .
Controlling overtime pay | Canadian HR Reporter
While it may seem counter-productive to penalize an employee for working overtime, that may need to be done to avoid unanticipated overtime costs in the future
Although it might seem as though the only thing we discuss these days is COVID-19 and all of the implications of that virus, we were recently reminded that "ordinary” employment law issues still exist when the Ontario Superior Court of Justice rendered a decision on an overtime class action that started way back in 2007.

Missoula County eyes federal grants for mental health, overtime during pandemic ~ Missoula Current
Federal funding could help Missoula County navigate the running cost of responding to the coronavirus pandemic, though things are happening so quickly, the effort remains a work in progress.
Commissioners last week signed off on two separate grants, including one that increases funding for the local COVID-19 response by $135,000.
While that’s "not a tremendous amount," as one commissioner put it, the funding will help supplement funding from an earlier Public Health Emergency Preparedness Grant.
