WOODSFIELD — At the request of the Monroe County Emergency Management Agency, the Monroe County Board of Commissioners approved an additional $20,000 to the department’s budget to aid with overtime pay due to the coronavirus pandemic.
EMA Director Phil Keevert met with Commissioners Mick Schumacher, Dave Price and Carl Davis to request the additional funding during Monday’s regularly scheduled meeting. Keevert said the department has been struggling to pay employee overtime amid the pandemic.

The Fair Labor Standards Act (FLSA) exempts certain highly-compensated employees (HCEs) from the requirement that they receive overtime pay for hours worked over 40 in a workweek. To be considered highly compensated, the employee must receive both (1) at least $684 per week paid on a salary or fee basis; and (2) at least $107,432 in total annual compensation.
In a recent opinion, the Fifth Circuit examined the job duties required to satisfy the HCE exemption. Smith v. Ochsner Health Sys. , No. 18-31264, — F.3d –, 2020 WL 1897186 (5th Cir. Apr. 17, 2020). Smith, a former organ procurement coordinator for Ochsner, sued for overtime pay under the FLSA. In response, Ochsner asserted the HCE exemption, arguing that Smith performed one or more administrative duties and received the required level of compensation.

The state attorney general’s office urged the Missouri Supreme Court on Wednesday to overturn a $113 million award to corrections officers who claim they are due pay for the time it takes to begin and end each shift.
Chief Justice George Draper alone was present in the Jefferson City courtroom. With others participating via teleconference due to COVID-19 concerns, the judges heard Assistant Attorney General John Sauer argue that the time spent on pre- and post-shift activities is minimal.

A restaurant chain with three eateries in central Pennsylvania shorted employees on minimum wage and didn't pay them overtime, federal investigators claim.
The target of the complaint by the U.S. Department of Labor is Montezuma of Pennsylvania Inc., which specializes in Mexican fare and has restaurants in Chambersburg, Waynesboro and Gettysburg.
According to the complaint filed in U.S. Middle District Court, the feds accuse the chain of not paying bussers and servers, who are tipped employees, the required minimum wage from September 2016 to September 2019. Also, the firm charged those tipped workers for the company shirts they had to wear during their shifts, investigators contend, again knocking their pay below the minimum wage.
