A final rule designed to give employers legal certainty when calculating overtime pay using the "fluctuating workweek" method for workers with irregular schedules is awaiting approval from the White House before public release.
The Labor Department transmitted the regulation Tuesday to the White House Office of Information and Regulatory Affairs, according to an online posting . The rule will undergo a review process that's typically the last phase before publication.

Salary increases for Linn County Undersheriff Paul Timm and six Sheriff's Office captains were approved Tuesday by the Linn County Board of Commissioners.
The undersheriff's pay will now range from $6,567 per month for the first step up to $8,489 per month after step six.
In a written report, Sheriff Jim Yon said the increases were necessary because the upper-level managers were actually earning less money than those they manage because, once they reach the captain level, they no longer qualify for overtime pay.

DOVER , Del. --- Kent County commissioners voted this week to cap essential workers like paramedics and staffers at its wastewater treatment facility to two weeks of overtime pay during the state of emergency prompted by the COVID-19 pandemic.
"This is an un-budgeted cost and, while we always plan some margin in our budgets, we did not anticipate some catastrophic situation that could take months to resolve," he said.
Petit de Mange said the additional cost to the county under the original provision was more than $30,000 and that figure did not include comp time that was awarded to employees who opted to accept the time off, rather than the pay bump.

Hero Pay will go towards overtime for essential employees in Mercer County | WVNS
PRINCETON, WV (WVNS) — Counties across West Virginia received Hero Pay grant money on Thursday, April 16, 2020.
Mercer County Commissioner, Greg Puckett, said there are still a lot of details to figure out, but that money will help pay overtime for essential personnel during the pandemic. Some of these jobs include law enforcement and emergency medical services.
Commissioners asked people in the county follow all of the guidelines to keep everyone safe. This way, the money can be more beneficial, instead of having to stretch it over time if the pandemic continues.
Colorado Hearing to Address Joint-Employment, Overtime Rules
Proposed changes to Colorado rules on joint-employment, overtime, and earnings statements are to be addressed at an upcoming hearing, the state labor agency said April 16.
The May 15 hearing is to be conducted by a remote connection, with participants attending by phone, computer, or other electronic devices, the Division of Labor Standards and Statistics said in a notice .
The proposed changes would amend and update the Colorado Overtime and Minimum Pay Standards Order Rules (7 CCR 1103-1), the Wage Protection Act (7 CCR 1103-7), and Wage and Hour Direct Investigation Rules (7 CCR 1103-8).
