Washington Farm Workers Ask State Supreme Court For Overtime Pay : NPR

For Ana, a farmworker, that means long days bent nearly doubled over to snap ripe strawberries from low bushes.

Ana moved to the U.S. from Mexico nearly 20 years ago. She asked that we not use her last name because she's undocumented.

Coronavirus cases in farm country have focused new attention on essential workers there, as well as the food supply chain. One issue is overtime. In most states, farm owners don't have to pay overtime to their employees. Now, a case before the Washington State Supreme Court could change that.

DOL Clarifies Requirements for Overtime Pay in Fluctuating Workweeks | Smith Anderson - JDSupra

The federal Department of Labor (DOL) has issued a final rule that will revise a Fair Labor Standards Act regulation to clarify that an employer may provide bonuses, premium pay, and hazard pay to non-exempt employees when using the fluctuating workweek method of overtime calculation.

Generally, an employee who is not exempt from receiving overtime under the FLSA is entitled to overtime pay at a rate equal to 1 ½ times their “regular rate” of pay for each hour worked over 40 hours per week.

Overtime Rule: The Department of Labor just expanded overtime pay - Vox

The Department of Labor just released the final rule that will require businesses to pay overtime wages to a much larger group of employees if they work more than 40 hours a week. It's a win for the estimated 1.3 million workers who will now be compensated for putting in long hours — but it's a bitter defeat for the 2.8 million others who would've also gotten overtime under the original rule proposed by the Obama administration.

It's here--the new DOL overtime rules, which look to be pretty much in line with the proposed rules. It's bittersweet. A real let down from the Obama rules (especially the automatic increases), but at least it finally updates the 2004 salary levels.

Workers, small business owners deliver 2,000 petitions backing overtime pay restoration | Beacon

Over 2,000 Maine workers, small business owners and community members addressed letters to the state legislature calling for lawmakers to pass a law that would double the number of salaried employees who qualify for overtime pay when they work over 40 hours.

Currently, just 20 percent of workers in Maine are automatically granted overtime pay under state law. That law stipulates that any salaried worker making less than $36,000 a year is guaranteed overtime protections.

Final Rules Regarding Overtime Pay Under the Fair Labor Standards Act (FLSA) - Lexology

On May 18, 2020, and again on May 20, the Department of Labor’s (DOL) Wage and Hour Division issued final rules regarding overtime pay under the Fair Labor Standards Act (FLSA). The May 20 final rule allows for employers to provide bonuses, compensation, and hazard pay to certain employees, while simultaneously being able to calculate overtime under the fluctuating workweek basis.
