For Ana, a farmworker, that means long days bent nearly doubled over to snap ripe strawberries from low bushes.
Ana moved to the U.S. from Mexico nearly 20 years ago. She asked that we not use her last name because she's undocumented.
Coronavirus cases in farm country have focused new attention on essential workers there, as well as the food supply chain. One issue is overtime. In most states, farm owners don't have to pay overtime to their employees. Now, a case before the Washington State Supreme Court could change that.

TRA workers have yet to receive overtime pay they are due for May and June, due to a budget shortfall, the union said.

Practitioners' questions are answered by a payroll and tax consultant who also is an enrolled agent licensed to practice before the Internal Revenue Service.
The Fair Labor Standards Act does not require that employees be paid for time not worked or to be provided extra pay for working on holidays. With respect to overtime, the FLSA requires that employees be paid at least one and one-half times their regular hourly rate for any hours worked in excess of 40 during the week.

Guidroz was employed by the Pointe Coupee Parish Sheriff's Office from 2008 until he left this year. When he was first hired he was making around $29,000, and when he left he was earning $42,000. Guidroz was issued a 2019 Dodge Ram Truck with 10 miles on it, but when it was turned in last month, it had 110,000 miles on it. Fuel receipts show Guidroz was fueling up nearly every other day outside of Pointe Coupee Parish. It's unclear what he was doing.

Corona overpaid city employees $540,000 last year for overtime work – Press Enterprise
Corona overpaid employees by about $540,000 last year for overtime work because of an error in payroll software the city bought in 1999 — and officials say the city may have been paying its workers too much for years.
The excess payment during the fiscal year that ended June 30, was discovered during an audit, officials said in a Thursday, July 30, news release.
City spokeswoman Cindy Solis said Friday, July 31, that an independent auditor will determine how many employees were overpaid and by how much.
EVERYDAY LEADERSHIP | Monroe County Beacon
In my experience, the coal mine supervisor had some leeway when filling out the pay sheets. At times, he could leave a couple of miners underground between shifts to perform a needed job. Other times, miners would be asked to work through their regularly scheduled lunchtime. In these cases, the foreman was allowed to pay a half hour or more overtime for these services.
I took every opportunity to work over when in the union. One day, I was asked to work between afternoon and midnight shifts on Oct. 17. Oct. 18 was my birthday and the union contract required triple time pay for working your birthday. The next night, the supervisor again asked for someone to work over and I again volunteered. He grinned and said, "No way, that would be triple time for you." I responded, "No, I think you will find triple time was last night.
Pandemic underscores need for California's gig worker law - SFChronicle.com
California’s Assembly Bill 5 went into a effect in January. The law stops companies from misclassifying their employees as independent contractors. As California grapples with the COVID-19 pandemic, the new law has illustrated how critical workplace protections are — particularly for those who are misclassified and treated like independent businesses when they are, in fact, employees.
Employee status grants basic rights and benefits to workers that we have agreed to as a society, including overtime pay, unemployment insurance, health and safety protections, disability insurance, paid family leave and more. When employers misclassify their workers as independent contractors, they gain an unfair advantage against competitors and shift costs onto workers and taxpayers.
Gujarat govt cancels overtime pay, SC issues notice in union plea - India Legal
The Supreme Court today issues notice on a plea challenging the Gujarat Govt’s notification extending work hours under Factories Act without overtime pay.
A bench of Justices DY Chandrachud and KM Joseph issued notice to the State of Gujarat and sought its reply.
The plea contended that the impugned notification has been purported to be issued under the powers conferred by section 5 of the Act and grants exemption from the aforementioned provisions of the Act for the period from April 20 to July 19, 2020.
