If January's minimum wage, tip, and overtime developments forecast what employers should expect throughout the remainder of the year, it could be a challenging 2020.

U.S. DOL Passes the Joint (Employer Rule) : On January 16, 2020, the U.S. Department of Labor (DOL) released its long-awaited final rule regarding joint-employer status under the federal Fair Labor Standards Act (FLSA), which will become effective March 16, 2020.

DOL, an Agency of Letters : The U.S. Department of Labor continues its opinion letter writing streak. One new opinion letter addresses calculating overtime pay for a non-discretionary lump sum bonus an employer pays at the end of a multi-week training period. Another opinion letter addresses whether per-project payments satisfy the salary basis test for the executive, administrative, and professional exemptions.

County maintenance workers to receive overtime rather than comp time | News | postregister.com

Two Jefferson County maintenance employees will be paid overtime, after a lengthy discussion Jan. 27.

Most Jefferson County employees receive compensatory time, or comp time, when they work more than 40 hours in a week. Jefferson County Sheriff Steve Anderson said he does not like paying employees that way, and said he would rather his maintenance employee receive overtime.

"If an employee works more than 40 hours in a work week, then a non-public employer must pay out overtime," Squires said. "As a public employer, where we have set budgets, it is allowable to pay comp time."

State Independent Regulatory Review Commission approves new overtime rules - South Pittsburgh

Governor Tom Wolf announced the state's Independent Regulatory Review Commission (IRRC) voted to approve the Department of Labor & Industry's final regulation that will extend overtime pay eligibility to 82,000 more workers.

"This is an important victory for thousands of workers," said Governor Wolf. "People who work overtime should be paid for it. This is absolutely the right thing to do.

"Today's approval of my plan will modernize our outdated overtime rules so more people are eligible for time-and-a-half pay. This will put more money in the pockets of workers and strengthen the middle class."

Pennsylvania Commission Approves New Rules Extending Overtime Pay for Thousands of Workers

Pennsylvania Governor Tom Wolf praised the state's Independent Regulatory Commission (IRRC) for approving the Depart of Labor & Industry's new overtime rules that are beneficial to workers.

According to Gov. Wolf, the new rules will extend overtime pay eligibility to additional 82,000 workers.

Under the new rules, full-time salaried workers in executive, administrative, and professional jobs making less than $45,500 by 2020 are eligible for overtime pay. The increase will be phased in over three steps"

Yonkers' top earners 2019: 98 employees made more than $225K

YONKERS - Some 98 city employees took home more than $225,000 in gross pay last year, when including overtime, retirement buyouts and other extra pay.

Twenty-three of those employees pulled in more than $250,000 in total. All of Yonkers' top 100 earners in 2019 worked for the police and fire departments.

Officials contend that it's very difficult for any municipality to prevent these sorts of modifications unless there's a change in state law.

Mass. gov proposes 'fix' for commission-only employees – New England In-House

Not surprisingly, attorneys who represent employers and those who represent employees disagree on both the process and potential end result of Massachusetts Gov. Charlie Baker's move to use a supplemental spending bill to respond to a decision by the Supreme Judicial Court in May 2019.

Baker's proposal — which seeks to "clarify the responsibilities of employers related to overtime for inside sales employees who are paid entirely on commission" — comes in the wake of Sullivan, et al. v. Sleepy's LLC, et al.

Lowe's employees file suit over pay :: WRAL.com

Mooresville, N.C. — In a class action lawsuit filed last week, employees of Lowe's home improvement allege the company shorted them owed pay in mis-calculating hours worked, failing to account for hours worked over 40 per week by salaried employees, in a violation of federal law.

The class includes employees in Massachusetts, New York, Pennsylvania and Oregon, but none so far in Lowe's home state of North Carolina. The company is headquartered in Mooresville.

Uber, Lyft drivers file wage theft claims – The San Francisco Examiner

Citing AB 5, more than 130 ride-hail drivers in San Francisco, Los Angeles and San Diego filed wage theft claims on Wednesday against ride-hail giants Uber and Lyft with the California Labor Commission Office.

“It’s the law in California,” said Chris Arellano, a member of Rideshare Drivers United, the 10,000-member organization that led the mass with help from the Transport Workers Union of America. “Uber and Lyft have refused to obey the law, and the state hasn’t enforced it.”
