Until now, employers have been left to guess if the FFCRA would extend into the new year or if Congress would pass a new piece of legislation redefining COVID relief in the workplace. On Monday, December 21, 2020, lawmakers decided they would not extend the FFCRA but instead will allow employers to decide if their company will continue to provide paid leave and, therefore, be eligible for the payroll tax credit. As currently drafted, this option is available until March 31, 2021.

For those still wanting to make tax-deductible charitable donations to local non-profits you have until Thursday evening to do so.
Emporia Community Foundation Director Becky Nurnberg recently spoke with KVOE News and explained that all donations will need to be made by New Year's Eve in order to be counted for the current tax year. Nurnberg says this year in particular they have seen a dramatic increase in the number of donations that have come into the foundation.
She says over $120,000 in donations came to the foundation just last week alone.

On Nov. 9, 2020, the Internal Revenue Service issued Notice 2020-75. For the first time, the notice approves of one of the techniques that states have used to help taxpayers avoid the $10,000 cap on the deduction of state and local taxes. However, that technique, involving shifting the tax to a pass-through entity, such as a partnership or S corporation, is only available to owners of businesses, not employees.

The $10,000 state and local tax deduction cap was enacted as part of the Tax Cuts and Jobs Act in 2017. In legislation passed only with Republican support, it was designed to limit the tax benefit to states that imposed high taxes, primarily Democratic states. Ever since its enactment, many Democrats in Congress have been calling for its repeal or modification. Up until this point, those efforts have been unsuccessful.

However, determinations are made by reference to the corporation's taxable year, not the fiscal year used for Exchange Act reporting purposes. Further, a corporation's Additional Officers are not necessarily the same as the named executive officers disclosed in the corporation's Exchange Act filings.
