2 former state troopers charged in overtime pay fraud scheme

Former police Lt. Daniel Griffin and Sgt. William Robertson are charged in federal court with conspiracy, federal programs embezzlement and wire fraud. Griffin also faces additional charges related to a separate scheme to defraud a private school, prosecutors said.

"Today's charges involve losses for the taxpayers, and also for the Massachusetts State Police, a premier law enforcement institution that must do a better job self-policing and eliminating this kind of misconduct," U.S. Attorney for Massachusetts Andrew Lelling said at a news conference announcing the charges.

Commissioners approve overtime pay for elections director - Washington Daily News | Washington

The Beaufort County Commissioners on Monday night approved $7,970.13 in overtime pay for Beaufort County Board of Elections Director Kellie Harris Hopkins, one day before Hopkins' department was scheduled to hold its hand-to-eye recount meeting for the N.C. Supreme Court chief justice contest.

Hopkins is an exempt employee, meaning she doesn't qualify for overtime pay. When the Commissioners met on Monday night, Board of Elections member Jason Williams reported that Hopkins had logged 450 hours of overtime between July 27 and the end of November. That is 173 more hours of overtime than she logged during the 2016 election cycle, according to Williams.

Can Employers Expect a New Overtime Rule Under Biden?

A controversial overtime pay rule from the former President Barack Obama's administration would have doubled the salary threshold for employees to be classified as exempt from overtime pay under federal law. In 2016, before the rule was implemented, a judge held that the administration exceeded its authority by raising the rate too high, but employers may be wondering if President-elect Joe Biden will revisit the rule.

Kathleen Caminiti, an attorney with Fisher Phillip in Murray Hill, N.J., thinks the Biden administration will prioritize raising the federal minimum wage from $7.25 to $15 an hour. Employers also may see efforts to increase the exempt salary threshold, she said, but the proposal would likely be lower than what was introduced by Obama's administration.

What Pennsylvania Employers Should Know About The New Overtime Regulations - Employment and HR -

For the first time in more than four decades, the Pennsylvania Department of Labor and Industry has modified the Commonwealth's overtime regulations. These amendments, which became effective on October 3, 2020, raise the minimum salary threshold for overtime exemption. They also modify the definitions of executive, administrative, and professional employees to make them more consistent with the Fair Labor Standards Act.

As a reminder, Pennsylvania employers are not required to pay overtime to an employee who works in a bona-fide executive, administrative or professional capacity, provided the employee's salary meets the minimum salary threshold. Recent revisions to the overtime regulations create a phased-in increase to the salary threshold as follows:

Paying for all hours worked by non-hourly employees

American Income required agents to undergo "rigorous" trainings which lasted "at least several weeks." During training, the agents frequently work more than eight hours per day, and six or more days per week. However, they do not earn money while training because their compensation is commission-based. The employer regulates its agents’ schedules, requiring off-site and in-office sales meetings to occur at certain times. Agents are generally not paid minimum wage or overtime pay.

The employees sued American Income for unpaid wages, unreimbursed expenses, and for missed meal and rest breaks.

C.A. Opinion Which Fails to Acknowledge Contrary Authority Becomes Final

A Court of Appeal opinion, which became final yesterday, holds that employees who receive their recompense solely from commissions are eligible for overtime pay, notwithstanding that the decision, based on federal regulations, overlooks a provision in the California Code of Regulations which declares to the contrary, as to some employees, and clashes with previous decisions, including those of the California Supreme Court.

Justice Thomas M. Goethals of the Fourth District�s Div. Three wrote the opinion in Semprini v. Wedbush Securities, Inc . , 2020 S.O.S. 5388, filed Nov. 9. It says:
