There are some weeks when, even though your employees have put in their 40 hours, you still need more work done. You can ask for that additional work from your employees, but it's going to cost you more per hour than you normally pay staff, taking the form of overtime pay.
Employees who work more than 40 hours a week are entitled to a higher rate of pay for the additional work. This is called overtime pay. Federal overtime laws require employers to pay certain employees who work more than 40 hours in a week at least "time and a half" for the extra time they put in. For example, if an employee makes $30 an hour, they would receive $45 for each hour of overtime they work.

AMSTERDAM — Legal counsel for Sticker Mule on Tuesday said the company admits an honest mistake was made with overtime pay calculations for its employees over the past two years, and the company has begun repaying the owed money.
Attorney Sal Ferlazzo, the in-house counsel for Sticker Mule, said attorneys representing former Sticker Mule employee Tierra Bonefort contacted the company approximately one month ago to alert them to her complaint that she had not received proper overtime pay while working for the sticker manufacturer.

GLOVERSVILLE — The Common Council on Tuesday approved a settlement agreement ending a civil lawsuit filed against the city by three retired firefighters seeking overtime pay. Under the agreement, the city will pay a total settlement fee of $110,000.
The complaint against the city was filed in the U.S. District Court in the Northern District of New York in 2019 by the Tuttle Law Firm on behalf of James Anderson, Robert Davis and David Rackmyre who sought to recover what they claimed was unpaid overtime compensation and other relief as provided for under the Fair Labor Standards Act.

Further, according to the DLI, Pennsylvania employers must follow both the federal overtime rules and the overtime requirements of the PWMA. Where there are differences between the federal and state rules, employers must follow the rules that are most beneficial to the employee. For example, unlike the FLSA, the PWMA does not recognize an exemption for computer professionals or highly compensated employees.

Maryland Corrections Lieutenant indicted in overtime theft scheme
BALTIMORE — A Lieutenant with Maryland's Department of Corrections has been indicted for allegedly stealing thousands of dollars in overtime pay.

Since July of 2019, prosecutors say Spooner would falsely claim approximately 80 hours of overtime each pay period.
He would indicate that he was working in one of the guard towers at one of two nearby Maryland correctional facilities.
As a supervisor, Spooner didn't have to clock in or out and was able to avoid filing routine paperwork, normally associated with overtime.

A former employee of Sticker Mule LLC and Print Bear LLC has filed a federal lawsuit alleging the two mutually owned sticker-making companies violated state and federal labor laws by failing to pay overtime wages at the correct rate over a two-year period.
Tierra Bonefort filed the lawsuit through her attorneys on Oct. 5 in the U.S. District Court for the Northern District of New York.
