Farm workers aren't paid overtime because of racist laws — Quartz

Cows don't work eight-hour days and so neither do the men and women who milk them. Dairies operate round the clock, often with two or three milkings a day. Dairy workers, often immigrants from Latin American, can work in excess of 60 hours a week (pdf) . And in most states they aren't paid overtime.

Farm workers are excluded from the overtime provisions of the Fair Labor Standards Act, the Depression-era law that created the modern 40-hour work week. And on small farms, they're also exempt from the minimum wage.

Pennsylvania finalizes overtime threshold increases, hitting $45K in 2022 | HR Dive

The FLSA requires that covered workers be paid time and one-half their regular rate for all hours worked over 40 in a workweek unless an exemption applies. The federal law provides several exemptions for white collar workers. If certain criteria are met, employers may not have to pay overtime to executive, administrative, professional, computer and outside sales employees, according to a fact sheet from the U.S. Department of Labor (DOL).

Employers must consider both salary and job duties in determining whether workers are exempt, sources previously told HR Dive . All of the exemptions except the outside sales exemption require employees to make more than $684 per week, according to changes in the FLSA salary threshold requirements that went into effect earlier this year. Once the salary threshold is met, the employee's job duties are considered.

Over 1,000 DC Police Officers are suing the city and MPD over hazard/overtime pay | WDVM 25

WASHINGTON (WDVM) — The District of Columbia and Metropolitan Police Department are being sued by over 1,000 DC police officers over hazard and overtime pay. The Collective Action Lawsuit was filed on Monday, October 5, in U.S. District Court and alleges that there has been a violation of the Fair Labor Standards Act.

Lead attorney for the case, Greg McGillivary, told WDVM the officers should be getting $14 per day hazard pay, as per an order by Mayor Muriel Bowser. The issue comes in the amount of overtime pay the officers should be receiving; with $14 per day hazard pay, overtime rate should be increased to about $2 an hour.

Japan's real wages fall for sixth straight month as pandemic bites | Reuters

TOKYO (Reuters) - Japan's inflation-adjusted real wages fell for the sixth straight month in August, reflecting a big drop in overtime pay due to the impact on the labour market from the COVID-19 pandemic, government data showed on Friday.

Labour ministry data showed real wages, a key barometer of households' purchasing power, dropped 1.4% in August from a year earlier, following a downwardly revised 1.8% decline in July.

Wage earners' nominal total cash earnings fell 1.3% to 273,263 yen ($2,578.68) in August from a year earlier, the fifth consecutive month of declines.

Minimum Salary Threshold for Pennsylvania White Collar Exemptions to Increase in 2021 and Beyond

The Pennsylvania Department of Labor & Industry recently amended Pennsylvania Minimum Wage Act (PMWA) regulations to increase the minimum salary employees must receive in 2021 and beyond to qualify for one of the so-called “white collar” ( i.e., executive, administrative, and professional) exemptions from overtime pay. The final rule became effective on October 3 after its publication in the Pennsylvania Bulletin .
