In our previous alert, we recognized that the new Pennsylvania overtime pay regulation, adopted in January 2020, would be effective upon publication in the Pennsylvania Bulletin. That date has now occurred. The Pennsylvania Bulletin finally published the overtime regulation so that the effective date for the new rules is October 3, 2020.

This means that the minimum salary required for exempt executives, administrators and professional (EAP) employees in Pennsylvania is now $684 per week ($35,568 annually) effective October 3, 2020, will be $780 weekly ($40,560 annually) effective October 3, 2021, and $875 weekly ($45,500 annually) effective October 3, 2022.

New Pennsylvania Overtime Exemption Minimum Salary Requirements Set to Exceed FLSA's Requirements

In what seems like an eternity ago, in June 2018, the Pennsylvania Department of Labor and Industry (DLI) proposed new regulations under the Pennsylvania Minimum Wage Act (PMWA) that would increase significantly the minimum salary requirement for the white-collar overtime exemptions under this law.

After many twists and turns, these regulations were published in their final form on October 3, 2020 and are now law in Pennsylvania. These regulations can be found here .

Whitmer Talks Overtime Pay In Wayne County

NEW BOSTON, Mich. (WWJ) -- Gov. Gretchen Whitmer's Overtime Rule Listening Tour -- her fight to expand overtime pay rights for Michigan workers -- made a stop in Wayne County Wednesday afternoon.

Whitmer held a "working lunch" at Tony's Coney Island in New Boston, meeting with several salaried workers to discuss a her proposal to bring more overtime rights to Michigan. 

"I talked to a woman who is a manager in a restaurant, working 70 hours a week, making $35,000 a year," Whitmer told WWJ. "When you look at the hours for what she’s putting in, she’s making almost minimum wage and has three kids to raise on that. She can’t get by. She needs overtime protection -- if she goes beyond the 40-hour work week, she should get paid for it."

More than 1,000 D.C. police officers, sergeants and detectives are suing the District, alleging they have been shorted pay while working overtime during the pandemic.

The police personnel, among the city workers who have been given a $14 daily increase in pay because of the coronavirus crisis, argue that as a result, their overtime pay also should be boosted.

The suit, filed this week in federal court in Washington, is organized by the police union, but because it does not involve a grievance dealing with the contract, 1,053 officers are listed as individual plaintiffs.

New PA overtime rule should boost pay for Lehigh Valley workers - The Morning Call

Thousands of middle class workers in the Lehigh Valley and statewide will benefit from a new rule designed to expand eligibility for overtime pay beyond a federal threshold.

But the move comes at a difficult time, as many employers try to recover from the coronavirus pandemic, say some attuned to Valley businesses.

The expansion ends about three years of work on the issue by Gov. Tom Wolf's administration. On Saturday, Pennsylvania adopted the federal standard that took effect in January, when the Trump administration increased the eligibility threshold for overtime to $684 a week, or $35,568 a year, from $455 a week, or $23,660 annually. Starting next year, Pennsylvania will exceed the federal standard.

Governor Wolf's new OT rules took effect on October 3, requiring employers to pay time-and-a-half to all workers who earn less than $45,500 a year and log more than 40 hours in a week.

Philadelphia, PA – October 6, 2020 – State Senator Christine Tartaglione applauded new overtime rules published in The Pennsylvania Bulletin on October 3 that require all Pennsylvania employers to pay time-and-a-half wages to employees who earn less than $45,500 a year and who log more than 40 hours in a workweek. The new base earnings threshold provides an additional 200,000 Pennsylvania workers with coverage under the state's overtime pay requirements, regardless of their job titles.
