Virginia Makes Sweeping Changes to Its Overtime Law | Arent Fox - JDSupra

The VOWA joins the FLSA in requiring employers to pay non-exempt employees 1-1/2 times their regular rate for all hours worked over 40 in a workweek. For employees paid on an hourly basis, the regular rate is the hourly rate of pay plus any other non-overtime wages paid or allocated for that workweek, excluding any amounts that are excluded from the regular rate by the FLSA.

However, for employees paid on a salary or other regular basis, the regular rate is 1/40th of all wages paid for that workweek. Importantly, this seems to preclude Virginia employers from paying non-exempt employees a fixed salary to cover straight time wages for hours over 40 in a workweek. It also seems to invalidate the fluctuating workweek method of paying overtime compensation that is permitted under the FLSA.

Report: MTA spent $1.1 billion in overtime pay in 2020; top earners work at LIRR | Newsday

Four of the MTA's top five overtime earners in 2020 worked for the Long Island Rail Road and more than tripled their income with six-figure extra earnings, according to a new report.

MTA chairman Patrick Foye said the agency remains focused on its highest overtime earners, although their pay doesn't necessarily indicate a problem.

"Most overtime, we believe, is authorized and earned," Foye said at the MTA's monthly board meeting. "I think the headline here is that we've reduced overtime by a couple hundred million dollars, down in two consecutive years."

If you've spent a career covering California cities, you've covered the public employee unions in those city halls.

Let's not even take sides here on the issue of whether they should have scored or not. They simply did.

The fact is it wasn't all that long ago in the grand sweep or our state's history that public employee unions were illegal. The great cliche was that while municipal jobs were underpaid compared with the private sector, there was at least decent security from being laid off or fired, and there would be a meager pension to look forward to in one's dotage.

Ever Given: Excavator Driver Getting Overtime Pay, Suez Bosses Say

The excavator driver who shot to fame for his work dislodging the massive Ever Given container ship from the Suez Canal ought to have been paid his overtime by now, the Suez Canal Authority said.

Officials at the SCA, which is owned by the Egyptian government, praised his work as "above and beyond" his obligation.

Abdel-Gawad does not work for the SCA but for a subcontractor. He told Insider at the time that while he fully expected to receive his overtime pay at some point, it was slow coming.

Ontario Employment Standards Act & Relocating to Work in Another Jurisdiction

Millions of Canadian employees have been forced to work from home as a result of measures designed to prevent the spread of COVID-19. Many of these employees continue to perform the same jobs they had before the pandemic started, just from different locations. However, the location where an employee preforms work often factors into which provincial employment standards legislation applies to the employment relationship.

For instance, a provincially regulated employee in Ontario who relocates to another province to work remotely may no longer fall under the jurisdiction of Ontario's Employment Standards Act, 2000 (ESA).

Biden to Pick Obama Alum Nayak as Labor Department Policy Chief

Nayak's nomination would signal bolder regulations on issues such as overtime pay, federal contracting mandates, and rules to achieve equity in the workplace. In a 2020 paper he co-authored , Nayak proposed overhauling the White House rulemaking review process to enhance regulatory capacity, and to give greater weight to inequality and worker interests when scrutinizing the need for agency rules.

The timing of an official announcement from the White House on its intent to nominate Nayak is unclear, but one of the sources—all of whom spoke on condition of anonymity—said it could be as soon as Friday.

Beaufort County Schools approves SRO services contract with Allied Universal - Washington Daily

The Beaufort County Schools Board of Education on Thursday unanimously approved Allied Universal as its third-party contractor for school resource officer services.

Allied Universal officers will assume those duties in August. The Beaufort County Sheriff's Office will continue to provide SRO services until the fiscal year ends in June.

BCS is the first public school system in North Carolina to contract with a third-party police company. Some other public school entities have similar arrangements, but the police forces are employed by their respective school systems in those cases. Beaufort County's SROs will be employees of Allied Universal, not BCS.
