Senate Bill would nix overtime pay for emails from home, ... clocked

An Ohio Senate committee is reviewing legislation that would shield employers from overtime pay requirements for hourly employees in certain situations.

The legislation, introduced by Republican Senators Andrew Brenner and Bob Peterson, would repeal overtime requirements for hours employees spend:

Current law requires employers to pay 1.5 times an employee's wage for hours worked more than 40 per week. Senate Bill 57 would allow employers to use a stingier accounting method for when the bonus pay kicks in.

Virginia Continues Pro-Employee Push with New Overtime Wage Act | Littler - JDSupra

Historically, Virginia has not had a standalone overtime law, instead relying on the federal Fair Labor Standards Act (FLSA) to provide protections to employees who work more than 40 hours a week.  But that will change on July 1, 2021.

Generally, under the FLSA, the same basic formula is used to determine each employee’s regular rate—all remuneration for employment, subject to certain statutory exclusions, divided by all hours worked in the workweek.  The new Virginia law, however, establishes a new formula for regular rate calculations for salaried employees in the Commonwealth.

Lawsuit claims Sidetrack bar in Ypsilanti took tips from employees, made them work off the clock

YPSILANTI, MI — A recent lawsuit filed against Sidetrack Bar & Grill in Ypsilanti alleges that employees were required to work off the clock and lost out on tips they had earned.

The lawsuit, filed in U.S. District Court in the Eastern District of Michigan, was filed by two former employees — Alana Hubbard and Jacob Redmon — and seeks to represent a class of former servers and bartenders who worked at the restaurant. While working at the restaurant, employees were paid below minimum wage as the business utilized a "tip-credit system" that they did not qualify for, according to the lawsuit.
