Do Improper Overtime Pay Calculations Automatically Equal Class Certification?

The Ninth Circuit last week affirmed a district court's denial of class certification of claims involving an alleged failure to properly calculate and pay overtime wages in violation of California law.

The plaintiff, Cindy Castillo, worked as an hourly employee at the bank's call center. She filed a lawsuit alleging various wage-hour violations under California law, with the main issue concerning the bank's policies and practices for calculating overtime wages.

Whitehall using CARES Act funds to pay overtime, support small businesses

Much of the funding Whitehall received from the Coronavirus Aid, Relief, and Economic Security Act has been used to pay for overtime, according to Mayor Kim Maggard.

The city is using its share of CARES Act funding to offset the cost of administrative overtime when Whitehall employees became ill from the COVID-19 coronavirus during the year, Maggard said.

The funding also been used for the salaries of safety-department employees, including overtime for them, she said.

Implement overtime pay option for teachers: union - Taipei Times

There are several reasons teachers might be asked to work at weekends, including parent-teacher meetings, accompanying students to competitions and taking part in local events such as exhibitions, federation president Hou Chun-liang (侯俊良) told at a news conference in Taipei.

Schools currently compensate teachers for working at weekends by allowing them to take hourly compensatory leave according to their needs within a year of the day worked, he said.

Police K9 handlers sue over compensation | Las Vegas Review-Journal

Four police K-9 handlers have filed a lawsuit against the Metropolitan Police Department and the state public employees retirement system, contending their compensation does not match the time it takes to care for and supervise the police service dogs.

Clark County District Court records show the lawsuit was filed by Metro police K-9 handlers Jeff Corbett, John Jenkins, Scott Murray and David Newton. The suit names the Public Employees’ Retirement System, the state of Nevada, Metro police, Clark County and city of Las Vegas as defendants.

The Washington State Supreme Court ruled the overtime exemption for dairy workers was unconstitutional Nov. 5. Since then, it has been a scramble for dairy farmers and their employees to figure out what to do in the aftermath of a decision that could cost dairy farms up to $120 million for following what was the law at the time.

The intervenors in the case, the Washington State Dairy Federation and the Washington Farm Bureau, have indicated they are petitioning the court for a reconsideration of their 5-4 ruling. The reconsideration puts the judgment on hold until that request is settled by the court.

Records obtained from the city of Albany earlier this month by The Enterprise show that, in 2019, Sherman logged 3,764.5 hours with the city, 52 percent (1,954.3) of which were overtime hours.

That comes out to over 72 paid hours per week, including on-call hours, figuring he worked all 52 weeks of the year.

Maintaining farm labor overtime thresholds | Farms.com

More than 20 industry groups from New York State are asking Governor Cuomo to maintain the 60-hour overtime threshold.

“Please know that if the overtime threshold for New York farm workers is lowered to a level below 60 hours per week, the face of New York agriculture will be irreparably altered and we will no longer remain economically competitive in the crops and commodities that require a labor force,” the groups said in a Nov. 23 letter .
