ST. LOUIS — The owner of three St. Louis area vape shops will have to pay backwages to dozens of employees after a federal investigation.
Marco DiMaiern, the owner of Coughing Cardinal LLC, violated the Fair Labor Standards Act's overtime and recordkeeping requirements, according to a press release issued Friday by the U.S Department of Labor. He will have to will pay 55 of his employees a total of $123,422.
The federal investigation revealed Coughing Cardinal and DiMaiern failed to pay employees overtime when they worked more than 40 hours during a work week, the release said. Instead, workers were paid flat salaries.

One area in which employment law in the U.S. Virgin Islands diverges from federal law concerns the circumstances that give rise to an obligation to pay overtime (calculated at one-and-one-half times the regular rate of pay) to nonexempt employees. In addition to earning overtime for any time worked over 40 hours in a week, nonexempt employees also are entitled to receive overtime for any time over 8 hours in one day or for any time worked on the sixth or seventh consecutive day in a workweek.
DOL WHD FLSA Opinion Letters
At the end of August, the U.S. Department of Labor's Wage and Hour Division ("WHD") issued four new opinion letters addressing various issues arising under the Fair Labor Standards Act ("FLSA"). The topics covered include the retail or service establishment, highly compensated employee, and professional exemptions; reimbursing non-exempt employees for required use of a personal vehicle; and the fluctuating workweek method of calculating overtime pay.
In Opinion Letter FLSA2020-11 , the WHD addresses whether truck drivers who earn a 27 percent commission on gross revenue received by the private oilfield service company for each truck they drive to transport fluid waste from customer oilfields to disposal facilities in specially equipped trucks qualify for the FLSA's retail or service establishment exemption.

Dairy, fruit and crop farmers across New York are overwhelmingly opposed to further reducing a new 60-hour overtime limit for farm workers.
The 60-hour threshold was one of many provisions, including a mandated weekly day of rest and giving workers the right to organize, included in the Farm Laborers Fair Labor Practices Act, which took effect Jan. 1.
