While most lawsuits in the trucking sector about overtime and minimum wage tend to focus on the number of hours drivers work, and whether they are entitled to at least the federal minimum wage if their rate per mile doesn't cover that target, logistics firm GlobalTranz is facing a different kind of lawsuit over that issue.
Two employees who worked in the company's logistics operations have filed suit in Arizona federal District Court seeking a class action against the 3PL, arguing that they were converted to exempt employees in April 2019. When that happened, and they were no longer paid by the hour, the number of hours they worked stayed at the same rate or increased while their pay was set as a salary.

CHICAGO — Potentially hundreds of Jewel-Osco employees will be given a chance to join a lawsuit alleging the grocery chain improperly denied overtime pay to assistant store directors.
The suit, filed in May in Chicago federal court, accuses Jewel-Osco, the largest grocery chain in the Chicago area, of misclassifying assistant store directors as salaried employees exempt from receiving overtime pay under federal labor law. It is one of numerous lawsuits claiming grocers and retailers cut their labor costs by giving employees managerial titles even as they do mostly manual work.

Kroger Co. again faces allegations it deliberately cheated hundreds of assistant grocery store managers out of overtime pay "to minimize labor costs," according to a Fair Labor Standards Act collective action filed Thursday in an Ohio federal court.
Thomas Schell and Christopher Riley, who worked as assistant managers at Kroger-branded stores in Columbus and Dayton, allege the company regularly required them and other similarly situated employees to work more than 40 hours per week.

Coachella, California, OKs 'hero pay' for essential workers, farmers
PALM SPRINGS, Calif. – The Coachella City Council in California unanimously approved so-called "hero pay" for certain essential workers Wednesday night, and extended the controversial hazard benefits to farmworkers.
The emergency ordinance requires certain agricultural operations – as well as grocery stores, retail pharmacy stores and restaurants – to provide a premium pay of an additional $4 per hour to their employees in Coachella for at least 120 days. The regulation applies to those who employ 300 or more workers nationally and more than five employees in the city.
