Dairy farming is not a 40-hour per week job. With labor laws becoming more restrictive, though, employers may have to treat it as such.
Overtime requirements were a topic of much discussion on the February 3 Hoard's Dairyman DairyLivestream focused on agricultural labor, as the standards being set by some states could create precedence for other parts of the country to follow.
Three top-10 dairy states are among those leading the charge with more protection for agricultural workers: California, New York, and Minnesota.

LUDLOW — Hampden County Sheriff Nick Cocchi recalls a time last year when his overtime spending was on pace to finish about $200,000 below what he spent in 2019.

Cocchi is the first to admit that, thanks to the COVID-19 pandemic, overtime spending for the Hampden County Sheriff's Department went through the roof. By year's end, the department's anticipated $200,000 surplus became a $7.4 million deficit. Overtime spending went from $1.3 million in 2019 to $8.6 million in 2020.

Opinion: Ruling on overtime could cripple Washington farmers | AGDAILY
It was an opinion that sent shockwaves through farms across the state of Washington. In November 2020, the Washington Supreme Court struck down overtime exemptions for agricultural workers at dairy farms. In a rambling opinion , the court determined that the exemption violated the state constitution because the legislature didn't have reasonable grounds for creating it.
But the truly shocking thing was the court's comments suggesting its decision should be applied retroactively. Although the issue wasn't properly in front of the court, and so not directly addressed, the majority's opinion included a footnote inviting additional lawsuits challenging the decision's implementation. And, remarkably, the court bluntly noted it would rule in favor of retroactive application.

Exempt Employee Can't Collect Damages in Dispute over Work Hours
An exempt employee who entered into an agreement with her employer to reduce her salary and hours was not entitled to damages when her hours increased but her salary did not, a California appeals court ruled.
The worker—who was paid all of her salary—could not collect additional wages under a breach of contract theory, the court said.
The employer, an advertising agency, hired her in 2008 as an associate media director to oversee the media planning for its clients. The employer offered her an annual salary of $135,000 as a full-time employee working a standard 40-hour week. The employer classified her as exempt under California wage and hour laws.
