As COVID-19 outbreaks intensify, employers throughout the country are mandating that their employees work from home.
Under the Fair Labor Standards Act (FLSA), non-exempt employees are entitled to pay and a half for hours worked over 40 per week. That’s true whether you’re working from home or at the office.
But employers are not required to pay you for hours you didn’t work. And when you work from home, you’re not under your employer’s direct supervision—so verifying the number of hours you worked can be a bit more complicated.

Thousands of Alberta government employees have been underpaid or not paid at all by their new payroll system, says the Alberta Union of Provincial Employees (AUPE).
Susan Slade, vice-president of AUPE, said the union estimates that about 5,000 employees have been underpaid by 1GX, a new system implemented by the government in December. She said the new system was rushed through and put in place before it was ready.
Since then, Slade said some workers haven't been paid for shifts and others are missing weekend and overtime payments. She said they still do not know the full extent of how many employees have been affected and it appears there are problems across the entirety of the provincial public sector.

A former Boston Police Department clerk forged her supervisors' signatures to boost her overtime pay by nearly $30,000 over a two-year period, federal prosecutors said Wednesday.
Marilyn Golisano, 68, is charged with embezzlement from an agency receiving federal funds, wire fraud and aggravated identity theft, according to a statement from the office of Andrew Lelling, U.S. attorney for Boston.
Golisano, who handled the overtime paperwork for her unit, submitted dozens of false and fraudulent overtime slips in 2017 and 2018 on which she had forged the signatures of at least three different supervisors, prosecutors allege.

CAPE CARTERET — Town commissioners Monday night approved a budget amendment to add funds to the Cape Carteret Police Department, but not without a familiar discussion.
The 4-1 vote came during the board's monthly session, conducted on GoToMeeting, and added $19,000 to the department's budget for overtime pay, pay for part-time officers and police vehicle maintenance costs that have already exceeded the amount budgeted.
Commissioner Mike King voted against the amendment, roughly six months after he was the sole opposition to adopting the 2020-21 town budget in June 2020. At that time, Mr. King said he couldn't vote for the budget because it dedicated too much money to the police department at the expense of other needs, such as parks and recreation and street repairs.

The timing is unfortunate for the department, which was already down by roughly 70 officers heading into 2021 and working to close the gap with an aggressive recruiting campaign.

Per Officer Buddy Calzada, officers are being pulled from specialized units to ensure that response times to 911 calls don't lag. He added that overtime pay is also being utilized.
"What we're doing is keeping everything on the front lines for our patrol," Calzada said. "We're making sure that stays stocked and well-staffed."
DOL Sharpens Meaning of Recreational 'Establishment' in Letter
The U.S. Labor Department narrowed its definition of amusement and recreational employers to those in fixed places after stating last year that it wouldn't take enforcement action against those types of employers affected by the Covid-19 pandemic.
In an opinion letter Friday, the department's Wage and Hour Division limited the definition of an "amusement and recreational establishment" to a physical location controlled by the entity, denying an online vendor offering adventure excursions for children and an event production company exemptions from the Fair Labor Standards Act's minimum wage and overtime pay requirements.
