Arizona AG settles with hearing device company over deceptive advertising

Brnovich’s office claims the Arizona-based company’s use of the terms conveys a message that the FDA favors or endorses a particular product or service, which the agency does not and cannot do.

The company’s conduct allegedly constituted an unfair and deceptive act and practice in violation of the Arizona Consumer Fraud Act, according to the settlement, and the FDA logo and terms must be removed from any of its advertising.

Brnovich last year warned consumers about possible misleading tactics after many over-the-counter hearing device companies entered the market following the FDA’s relaxation of restrictions on hearing amplifier devices in 2017.

Poliakoff: HOA must respond to request to inspect records

Let's separate out two different issues—the first being the record inspection request, and the second being the budgeting questions.

Just as is the case in condominiums and cooperatives, a homeowner's association is obligated to respond to a lot owner's written request to inspect records. Section 720.303, Fla. Stat.

As for the budget, remember that a budget is a good faith best estimate of where monies are going to be spent. It's generally prepared based on expenditures from the prior year (and taking into account future expenditures), but budgets do vary, and it is normal to go over-budget in some categories, and under-budget in others. That is not a legal violation unless perhaps the board knowingly prepared a fraudulent budget (which I think is very unlikely in your situation).
