Lewes police officers want to be paid overtime for the length of the ongoing state of emergency.
The police department's contract, which was negotiated by General Teamsters Local 326 on behalf of officers, states that all time worked during a state of emergency shall be paid at the overtime rate for the duration of the emergency.
The city paid officers overtime from March 12 through May 17 before stopping. The Teamsters filed an unfair labor practice claim against the City of Lewes with the Delaware Public Employment Relations Board June 9. The city currently has 12 officers, including Police Chief Tom Spell and Lt. James Azato; however, the top two officers have their own contracts with the city and are not involved in the current dispute.

Buffalo, NY (WBEN) - High-ranking, salaried administrators have cashed in on overtime pay during the Coronavirus crisis.
A report issued by Erie County Comptroller Stefan Mychajliw shows that political appointees in the County made $825,039 in overtime pay during the 18-weeks of Coronavirus crisis work.

That includes $441,655 in pay to the Erie County Sheriff's office, and $83,996 in overtime payments to Erie County Health Commissioner Dr. Gale Burstein. Out of the 54 employees listed in the overtime pay report, only three, including Burstein, work in the Health Department.

Lawsuit calls for overtime pay for King Soopers assistant managers – Loveland
A Colorado man filed a class-action lawsuit this week in U.S. District Court in Denver alleging that King Soopers and parent companies The Kroger Co. and Dillon Cos. have systematically violated labor laws by withholding overtime pay from assistant store managers.
Attorneys for William Powell, a Littleton resident who worked at a Grand Junction King Soopers from 2016 to 2019, claim that the grocery chain incorrectly classifies assistant managers as exempt from overtime pay despite those employees’ having essentially the same job function as hourly employees who are eligible to be paid time and a half when they work more than 40 hours in a week or 12 hours in a day.

Wash. White Collar Overtime Exemption Rules Take Effect
Overtime exemption rules generally require "white collar" – those performing executive, administrative, and professional duties – employees to meet a three-part test to be exempt; the worker must (1) be paid a fixed salary, (2) perform certain types of job duties, and (3) be compensated at or above a minimum salary threshold. The L&I's revised rules change the minimum salary level and the job duties test.
Under the approved changes, the minimum pay a salaried worker must receive to be considered overtime-exempt will increase incrementally to 2.5 times the state minimum wage by 2028. Small employers (1–50 Washington-based employees) will have a more gradual phase-in schedule to give them additional time to comply with the new rules as compared to large companies (51 or more Washington-based employees).

From Sunday, May 31, to Sunday, June 7, the entire Omaha Police Department was put on the "Alpha Bravo" shift. That meant all officers were scheduled to work every day, with 12-hour shifts instead of the normal eight hours. Many officers worked longer than 12 hours a day.

ERIE COUNTY, N.Y. (WIVB)–We looked into how much overtime was paid out to Sheriff’s Office employees, and where that money is coming from.
Legislator Timothy Meyers provided News 4 with data Wednesday that showed 13 Erie County Sheriff’s employees had racked up more than $400,000 in overtime during the pandemic.
Those 13 Sheriff’s Office employees would otherwise not be eligible for cash overtime without the State of Emergency declaration.
Trump Judge Casts Deciding Vote to Block Discovery of Important Information in Overtime
Trump Fifth Circuit judge Kyle Duncan cast the deciding vote to stop a district court from even allowing discovery of important information about an employer's failure to classify a number of employees as eligible for overtime pay under the Fair Labor Standards Act (FLSA). The June 2020 case is In re Schlumberger Technology Corp.
The district court denied STC's motion and sided with the plaintiffs on the requested discovery, determining that STC had waived the privilege by claiming that it had made good faith efforts to comply with FLSA. STC went straight to the Fifth Circuit court of appeals even while the case was still pending, seeking the unusual remedy of a writ of mandamus to compel the district court to grant its motion, strike part of Hanley's deposition, and forbid disclosure of the classification reports.
