Erie County Legislators question overtime pay during pandemic | News 4 Buffalo

ERIE COUNTY, N.Y. (WIVB)–Some Erie County Legislators want to know exactly what employees were doing to receive more than $3 million in overtime pay since March.

“Those people are on salary and you would expect that they’re not going to be taking cash overtime during these types of things,” County Legislature Joe Lorigo said.

Chairwoman April Baskin says, “The question is for the administrative staff that has a some odd amount of over $450,000 in overtime pay in three or four months’ time, what exactly was it that you guys were doing?”

Washington's Revised "White Collar" Overtime Exemption Rules Now in Effect - Lexology

Overtime exemption rules generally require “white collar” – those performing executive, administrative, and professional duties – employees to meet a three-part test to be exempt; the worker must (1) be paid a fixed salary, (2) perform certain types of job duties, and (3) be compensated at or above a minimum salary threshold. The L&I’s revised rules change the minimum salary level and the job duties test.

On January 1, 2021, employers should begin following the new Washington rules because the state threshold will become more favorable at $827 a week (1.5 times the state minimum wage) for small employers, and approximately $965 per week (1.75 times the state minimum wage) for large businesses.

Home Health Aides Get Class Status in N.Y. Overtime, Notice Suit

A New York federal judge ruled Wednesday that more than 165 home health aides may proceed as a certified class on state-law claims that their employer cheated them out of overtime pay and didn't provide wage notices in their primary languages.

NYPD will miss overtime cap by $400M, IBO predicts

The NYPD will likely exceed its new overtime cap by hundreds of millions of dollars, an independent budget watchdog said, undermining another key part of Mayor Bill de Blasio's claim to have cut the police budget by $1 billion.

The Independent Budget Office projects in a new report that the NYPD will exceed its new overtime cap by $400 million.

De Blasio and the City Council reached a budget deal they said would shave $1 billion from the NYPD budget after weeks of protests where demands focused around defunding the police. Since passing the budget during the early hours of July 1, though, much of the $1 billion reduction has been called into question for this year's fiscal plan. The overtime report is the latest indication that the actual reduction could be far less than protesters and many city leaders hoped for.

Thank You, Next Guidance Please — Everything You Need to Know About the Wage and Hour Division's

The U.S. Department of Labor’s Wage and Hour Division earlier this week published additional employer guidance regarding compliance with the FLSA during the COVID-19 pandemic (“ Guidance ”).  The Guidance is a helpful aide in understanding general wage and hour principles during the crisis.

The Guidance clarifies that employers generally may require employees who are covered by the FLSA to pay for business expenses associated with teleworking (internet access, increased use of electricity, laptop, etc.), unless doing so reduces the employee’s earnings below the required minimum wage or overtime compensation.  But there are other laws to bear in mind:

French air controllers still on overtime pay despite Covid

The bonuses are still being given to 2,000 air controllers in France, it has emerged, even though the money is intended to remunerate extra work undertaken during the typically busy summer period.

An anonymous employee from executive management in France's civil aviation body, la Direction Générale de l'Aviation Civile , told news source Franceinfo : "It's frankly indecent to have a bonus at this level for work that hasn't been done because the traffic is not there. And, yet, a certain number of controllers are still going to be paid for 'increasing their productivity'."
