Japan's May overtime pay logs biggest-ever dip | The Japan Times

Japan’s average overtime pay for May dropped 25.8 percent from a year earlier to ¥14,601 ($136) amid the coronavirus pandemic, marking the sharpest fall since comparable data first became available in 2013, the labor ministry said Tuesday.

Reflecting business suspensions under the state of emergency, which remained in effect for almost the whole of the reporting month, overtime hours also fell 29.7 percent on average, the ministry’s preliminary data on monthly wages showed.

Yen drops after weak Japanese household spending and overtime pay

The Japanese yen eased slightly after the statistics office released the household spending data from Japan. The numbers showed that spending declined by 0.1% in May, after falling by 6.2% in the previous month. On an annualised basis, the spending declined by 16.2%. This is mostly because Japan was in a state of emergency in May as the number of coronavirus cases rose. The overall wage income of employees declined by 2.1%.

The New Zealand dollar eased slightly as traders reflected on the latest business confidence number from New Zealand. According to the NZ Institute of Economic Research, economic activity dropped sharply in June. The net 37% of companies that reported a decline in trading activity was the lowest it has been since 2009. 25% of companies said that they expect weaker demand in the third quarter. That confidence was slightly better than the -70% that was reported in the previous month.

Second Circuit Affirms Use Of Fluctuating Workweek Pay Method For 'Big Box' Store District

Concluding that the company properly used the fluctuating workweek (FWW) pay method, the Second Circuit Court of Appeals has affirmed summary judgment in favor of retailer Bed Bath & Beyond in a Fair Labor Standards Act (FLSA) collective action brought by a group of former district managers. Thomas v. Bed Bath & Beyond , 2020 U.S. App. LEXIS 18747 (2d Cir. June 15, 2020).

In so holding, the Court of Appeals concurred with several aspects of the U.S. Department of Labor’s (DOL) recently published Final Rule on the fluctuating workweek pay method.

In-home health provider agrees to $12.5M wage and hour settlement | HR Dive

The FLSA requires employers to pay nonexempt workers time and one half their regular rate of pay for all hours worked beyond 40 in a workweek.

Overtime violations are a frequent topic of wage and hour litigation, and they often generate expensive settlements. A Panera Bread operator, Covelli Enterprises, for example, recently agreed to pay $4.6 million to settle a class action lawsuit alleging assistant managers were improperly classified as exempt from overtime pay.

Updates to Washington's rules that spell out what type of workers don't have to receive overtime pay took effect as of July 1.

These rules establish the criteria for certain workers to be considered exempt from getting overtime pay and other protections under the State Minimum Wage Act.

New Virginia Wage and Hour and Pregnancy ... Laws Effective July 1, 2020

The Virginia Wage Payment Act (Va. Code § 40.1-29) (the “Act”) is intended to curb “wage theft” within the Commonwealth by, among other things, prohibiting employers from reducing or withholding employee wages other than for lawful deductions, and requiring that employees whose jobs have been terminated receive all wages owed by their next regularly scheduled pay date.

Historically, employees who believed they were not paid in accordance with the Act had been required to file an administrative claim with the Virginia Department of Labor and Industry (DOLI), the state agency authorized to enforce wage and hour regulations. That agency could then choose to sue on the employee’s behalf, but the employee could not file a lawsuit of their own.

DOL Issues New Wage and Hour Opinion Letters | Foley & Lardner LLP - JDSupra

On June 26, 2020, the U.S. Department of Labor (DOL) issued several unrelated opinion letters dealing with non-COVID wage and hour issues.

Specifically, two of the opinion letters, FLSA2020-6 and FLSA2020-8 , deal with the outside sales exemption to the Fair Labor Standards Act (FLSA). Under that exemption , the FLSA’s minimum wage and overtime requirements do not apply to employees: (a) whose primary duty is making sales (or obtaining contracts for services or the use of facilities); and (b) who customarily and regularly are engaged away from the employer’s place of business.

Seattle City Council could make deeper cuts to Police Department budget than proposed by Mayor

Durkan has asked staff to research by the end of July what cuts of 20%, 30% and 50% would look like as she develops a 2021 budget proposal and has vowed to solicit input from community members.

Those reductions, totaling about $16 million, all were identified in response to the pandemic and the city’s revenue problems, her office said.

The mayor also has instructed the Police Department to stop hiring officers this year. That won’t save much money, according to the department, because more officers than expected were hired at the start of 2020.
