Pittsburgh home health care agency to pay $1.6M in wages, damages for ducking overtime |

A Pittsburgh home health care agency is required to pay more than $1.6 million in back wages and damages to hundreds of employees — as part of a settlement — after it misclassified them and failed to pay overtime.

The U.S. Department of Labor filed a complaint against Christian Home Healthcare, owned by India Christian, in September 2018. The business, based on the North Side, began operating in 2003, according to its website.

An investigation showed that the agency misclassified 546 home health aides as independent contractors and then failed to pay them overtime. Of the money to be paid, $812,675 represents back wages, and there is an equal amount in damages.

Suffolk County officials approved $2 million in tax breaks for a wholesale distributor of perfume and beauty products, but not before warning the owner to pay overtime to employees.

Unpaid overtime is the subject of a 2017 federal lawsuit filed against Perfume Worldwide Inc. by a group of former employees. The county's Industrial Development Agency was not aware of the suit in January when it granted preliminary approval for the tax breaks. IDA officials became aware of the suit from Newsday reporting.

Class action claims unpaid work, OT violations at Sun-Maid | HR Dive

Employers generally must pay nonexempt employees overtime for hours worked beyond 40 in a workweek, according to the U.S. Department of Labor (DOL). To calculate overtime pay, employers should provide workers with at least 150% of their regular rate of pay. DOL offers an equation to determine a worker's regular rate: divide total compensation for the workweek by total hours worked in the workweek.

But what constitutes total compensation is sometimes unclear. The regular rate of pay under the FLSA includes "all remuneration for employment paid to, or on behalf of, the employee," according to DOL , but some gift or discretionary bonuses can be excluded.
