Colorado panel hears bill on farmworker wages, rights
DENVER (AP) — A Colorado state Senate panel heard testimony Wednesday on a bill to grant minimum wage and overtime rights to thousands of farmworkers and allow those workers to organize and join labor unions.
Several U.S. states allow farmworkers collective bargaining to some extent — rights originally denied them on the basis of skin color under U.S. labor laws first adopted in the 1930s.
Last year, Washington became the first state to grant farmworkers overtime protections through the courts. California is phasing in some overtime protections, while New York last year began requiring overtime pay when farmworkers work more than 60 hours in a week. Maryland and Minnesota also offer overtime protections to farmworkers.

The FLSA requires that employers pay workers overtime at a rate of no less than time-and-a-half for all hours beyond 40 worked in a workweek, unless an exemption applies.
To determine whether workers are exempt from the FLSA's overtime pay requirements , employers must apply salary and duties tests. The salary test requires that most workers be paid more than $684 a week to qualify for an exemption from overtime pay. Once the salary threshold is met, the employee's job duties must be examined.
Measure allowing overtime for farmworkers moves forward in Washington state | Farm Forum |
SPOKANE, Wash. — Agricultural workers in Washington state would become eligible for overtime pay under a bill moving through the Legislature in Olympia.
Somewhat surprisingly, the bill enjoys bipartisan support and even has the backing of farm employers who say it will bring a level of certainty to their labor costs. Farmworkers have been exempted from overtime pay since 1938, although some states such as California and New York have extended those protections in recent years.

California-Based Flight Attendants Are Protected By California's Overtime And Meal/Rest Break
While the Ninth Circuit's recent decision in Bernstein v. Virgin America, Inc., et al. , ___ F.3d ____, 2021 U.S. App. LEXIS 5197 (9th Cir. Feb. 23, 2021), gave some wins to the airlines, air carriers employing California-based flight crewmembers must, as a practical matter, now abide by the state's stringent wage and hour laws – even if the crewmembers in question perform most of their work out of state.
Bernstein is a class action brought by flight attendants for Virgin – a former California-based carrier – who alleged that the carrier violated California's wage and hour laws. The primary issue was whether California's wage and hour laws applied. The class members, all of whom were based in California, spent approximately 31.5% of their time working within California's borders.
