To protect small businesses from "being punished for doing the right thing," half a dozen local business owners held a press conference at the Portland Hunt & Alpine Club on Wednesday to call on members of the Maine legislature to pass LD 402 , a bill that would guarantee overtime pay for an additional 28,000 salaried workers in the state.
Dozens of members of the Maine Small Business Coalition, which represents over 4,000 small business owners like Volk across the state, signed on to a public statement supporting LD 402 in February. The statement declares that worker protections like overtime are necessary to help small businesses compete with large, out-of-state corporations that take advantage of outdated wage and hour laws to avoid fully compensating their employees.

In 2016, we reported that some BART workers were nearly tripling their salary with overtime pay. According to new data recently obtained by ABC7 , things haven’t changed much.
The news station analyzed the 2018 compensation for all BART employees and found that a BART senior police officer made more than $172,000 in overtime that year, making their total pay more than $279,000.
Another employee, a station agent, worked 361 out of 365 days at more than 40 different stations, making more than $114,000 in overtime. Combined with regular pay, the station agent made nearly $200,000. This prompted ABC7 to question the safety of this level of work.

New Overtime Pay Regulation in Pennsylvania May Create Obligations for Employers Beyond Federal
On January 31, 2020, the Pennsylvania Independent Regulatory Review Commission (IRRC) adopted an amendment promulgated by the Pennsylvania Department of Labor and Industry (DLI) to increase the minimum salary required to avoid overtime compensation for Executive, Administrative and/or Professional (EAP) workers. The new minimum salary is $684 per week ($35,568 annually).
The new required minimum salary in Pennsylvania matches the new federal threshold which became effective January 1, 2020, but in 2021 (one year after the new regulation is published in the Pennsylvania Bulletin) the Pennsylvania minimum will exceed the federal level. The amendment also attempts to align Pennsylvania’s “duties tests” with the federal regulations, but gaps remain, including the differing salary thresholds beginning in 2021.
Atlanta-Area Restaurant Operator to Pay $411,010 to Employees After Minimum Wage, Overtime
DORAVILLE, GA – After an investigation by the U.S. Department of Labor's Wage and Hour Division (WHD), the operator of an Atlanta-area restaurant enterprise will pay $411,010 in back wages to 157 employees at locations in Doraville and Duluth, Georgia, for violating minimum wage and overtime requirements of the Fair Labor Standards Act (FLSA).
WHD investigators found La Abuela LLC in Doraville, and La Abuela II LLC, La Abuela III LLC and La Abuela IV LLC in Duluth – incorrectly classified employees as independent contractors, leading to numerous violations. The restaurant operator violated FLSA overtime requirements by paying straight-time rates for all the hours employees worked, failing to pay overtime when they worked more than 40 hours in a workweek.
