Diamond Resorts Workers Get Partial Wins in Overtime Pay Suits

Diamond Resorts International Marketing Inc. failed to fully compensate concierges, marketing supervisors, and vacation counselors and failed to show they are exempt workers under federal labor law, the District of Nevada ruled.

The company and affiliate West Maui Resorts Partners LP didn't show the workers fall under a "retail or service establishment exemption" recognized under the Fair Labor and Standards Act, which would have relieved them of the obligation to pay the workers for overtime hours worked, the court said.

State Senators Tom O’Mara, Pam Helming and their GOP colleagues are urging the state Farm Laborers Wage Board not to lower the threshold for farm workers to receive overtime from 60 to 40 hours per week.

Under the Farmworkers Fair Labor Practices Act signed into law in 2019, farm laborers in the state became entitled to overtime pay for the first time. The law included the creation of a board that is authorized to change the threshold without legislative approval.
