Diamond Resorts Workers Get Partial Wins in Overtime Pay Suits

Diamond Resorts International Marketing Inc. failed to fully compensate concierges, marketing supervisors, and vacation counselors and failed to show they are exempt workers under federal labor law, the District of Nevada ruled.

The company and affiliate West Maui Resorts Partners LP didn't show the workers fall under a "retail or service establishment exemption" recognized under the Fair Labor and Standards Act, which would have relieved them of the obligation to pay the workers for overtime hours worked, the court said.

Minimum wage, overtime, and workers' comp premium changes take effect in new year - KXRO

Changes in the minimum wage, overtime for white-collar professionals, overtime for agricultural workers, and workers' compensation premiums will take effect Jan. 1, 2022.

The Washington State Department of Labor & Industries (L&I) sent out the reminder for businesses and employees.

New York Supermarket Sued for Unpaid Overtime Wages - Agriculture

The plaintiff began her employment with the defendant in 2017. As an employee of the defendant, she works in the produce section of the Key Food Supermarket where her duties are to make salads and cut fruit.

The complaint also details the amount of work the plaintiff was given – an amount which she claims made it impossible for her to take a break throughout the day. She contends that she "complained various times about not having a break.

Unlike Erie, other New York counties not paying COVID OT to top health officials

Nurse practitioner Kimberly Kaplan, Greene County Director of Public Health, made $3,100 in pandemic overtime in 2020.

According to the county comptroller, Burstein's base salary in 2020 was $207,292 and in 2021 it was $209,044. Her overtime and comp payment over the two-year period paid $284,857. That brings the total payment over two years to $701,193.

Giant Eagle to pay out up to $4.2 million in settlement with store team leaders over unpaid

O'Hara-based Giant Eagle Inc. has agreed to pay out up to $4.2 million along with attorney's fees to a group of store managers known as "senior team leaders" in company parlance over alleged federal Fair Labor Standards Act violations, according to legal documents.

A settlement was finalized in court a little more than a week ago over a "collective action" lawsuit originally filed in April 2018 by Andrew Fitch , a former senior team leader of a GetGo store in Indianapolis.

Historic pay raise leads to 300% increase in new applicants to the Nebraska Department of

Ohio's minimum wage bumps to $9.30 in 2022 - Cincinnati Business Courier

Ohio's minimum wage will rise 50 cents an hour, from $8.80 to $9.30, when the calendar switches to 2022. Workers who receive tips will see an increase in  minimum pay from $4.40 per hour to $4.65.

The state's minimum wage is $2.05 more than the federal minimum wage, which has been at $7.25 per hour since 2009. For Ohio businesses with gross receipts of less than $342,000 in 2021, and for those workers under the age of 16, the minimum wage remains $7.25.

[COLUMN] 'Managers' may still be owed overtime —

PAMELA Ruben-Knudsen and Marnine Casillas were employed as Client Service Managers by Arthur J. Gallagher and Co., a brokerage firm. Client service managers are salaried and considered exempt from overtime.

Pamela and Marnine do not manage or supervise other employees. They have no authority to exercise their discretion or independent judgment. They regularly perform clerical tasks according to specific instructions.

Staffing shortages continue for first responders

Dec. 30—As the year winds down, the staffing shortfalls that have plagued the Wilson County Emergency Management Agency (WEMA) are showing no signs of slowing. As the county waits on the results of a pay study before moving to bolster benefits, it's had to put a Band-Aid on the problem.

ANNAPOLIS, Md. –– As we prepare for 2022, some people will have a pleasant surprise to start the new year with a larger paycheck.

Effective on Saturday, Jan. 1, 2022, the minimum wage in Maryland goes from $11.75 to $12.50 an hour for employers with 15 or more employees, according to the Maryland Department of Labor. The new minimum wage for employers with 14 employees or less will be $12.20 an hour.
