DOL Allows Premium Payments in Fluctuating Workweek Payment Method
On May 20, 2020, the Department of Labor announced a final rule revising its regulation for computing overtime compensation of salaried nonexempt employees who work hours that vary each week.
This final rule is helpful to employers and employees in the current COVID-19 environment, where businesses are increasingly implementing flexible work schedules and utilizing special forms of payment to incentivize and thank employees on the front lines.
The rule clarifies that payments in addition to the fixed salary are compatible with the use of the fluctuating workweek method of compensation under the Fair Labor Standards Act (FLSA).

CHG Medical Staffing Must Include Travel Pay in Overtime Rates
CHG Medical Staffing Inc. owes unpaid wages and liquidated damages to more than 500 traveling nurses and technicians, after a California federal court ruled that their weekly per diems should have been included in their overtime calculations.
The per diems are compensation for work, not reasonable reimbursements for travel expenses, because CHG adjusts them based on how many hours the traveling employees worked in a given week, Judge Dale A. Drozd of the U.S. District Court for the Eastern District of California said May 15.

After joining the war effort in 2006 and serving in the U.S. Army, including a combat tour in Iraq, I found myself questioning the sincerity of flipping burgers in the backyard as an homage to the brothers-in-arms who didn't accompany me home.
