Paying extra while pandemic closed county building topic of grievance

MUNCIE, Ind. — A Delaware County sheriff's deputy approached Delaware County Council members Tuesday to ask them to deliver overtime pay for the period deputies worked while the County Building was closed due to the COVID-19 pandemic.

United Auto Workers Local 321 has filed a grievance against the county claiming failure to pay time and a half while the county building was closed violates the labor contract the county has with the union representing deputies.

Question: Our operations director is convinced that the workweek varies for an employee based on the employee's work schedule. He claims that the workweek starts the first day at work after a day off and continues for consecutive days until the next day off.

Answer: The operations manager is misinterpreting the rules related to workweeks. Essentially, a workweek provides a timeframe for determining whether minimum-wage and overtime requirements are met.
