Plastipak Gets Employee's Overtime Award Reversed by 11th Cir.

Plastipak Packaging Inc. is off the hook from paying $1,820 in damages to an employee who alleged the company miscalculated his overtime rates under the Fair Labor Standards Act, the Eleventh Circuit ruled Wednesday.

Plastipak was entitled to use the FLSA's fluctuating workweek method to calculate Hector Hernandez's overtime pay, even though he received bonuses for working nights and holidays in addition to his fixed salary, the U.S. Court of Appeals for the Eleventh Circuit said.

Ag briefs: Colorado seeks input on overtime rules

The Colorado Department of Labor and Employment is seeking input on preliminary overtime rules, which recently were published. Producers are urged to review the CDLE overtime pay proposal as soon as possible and make comments to CDLE if warranted.

This year's Kansas Tourism Conference is being held at the Fairfield Inn in Liberal Oct. 18-20. The meeting will include a legislative panel, a general session on "the state of the American traveler" and other travel program updates. For the full agenda, go to TIAK.org/events.

Fifth Circuit Holds that Not All Jones Act Seamen are FLSA Seamen; Some Entitled to Overtime |

In denying an en banc rehearing of Adams v. All Coast , LLC, the Fifth Circuit held that not all Jones Act Seamen are FLSA Seamen.

Employers of seamen should take note of this ruling and its narrow definition of “seaman” under the FLSA.

As was noted by the dissenting judges, this ruling raises very real concerns for maritime employers and the maritime industry as a whole about to how to ensure offshore employees are paid properly.
