Movie Theater Employees Take Aim at Overtime Pay Exemption | Hollywood Reporter

While a strong December film slate helped lead U.S. box office revenue to a projected $11.4 billion in 2019 (down 4 percent year-over-year), many lower-level employees at top theater chains in multiple states worked without overtime or holiday pay — as they have for much of the past century.

Now, a widely circulated petition by staffers at AMC Theatres is hoping to draw attention to a longtime exemption in 1938's federal Fair Labor Standards Act that allows exhibitors to refrain from providing staff with time-and-a-half pay rates in states without strict overtime laws.

About 1,600 salaried workers in Maine will be newly eligible for overtime pay under regulations that will take effect Wednesday.

Federal and state laws require that salaried administrative workers who earn less than a set threshold – $33,000 under current Maine law – be paid overtime for hours they work in excess of 40 hours a week. But that threshold is increasing with the new year – in Maine’s case to $36,000 a year. The rules affect white-collar jobs and also require that workers meet a duties test to make sure that they qualify as administrative, professional or other job classifications under the law.

Union rules, not wildfires, the root of high firefighter overtime costs – Daily News

Overtime pay for Los Angeles firefighters is making national headlines again, thanks to eye-popping payouts that allowed several employees to pocket over $400,000 apiece last year.

Unfortunately, many news reports have badly misdiagnosed the cause, misleading voters just months ahead of a proposed tax hike. Recent articles in USA TODAY and the Los Angeles Times, for example, suggested the recent spike in wildfires is to blame, but provided no evidence to support that claim.

Metro Detroit car wash underpays overtime, doles out $83k

Employees of a Detroit metro-area car wash got an extra payday after the U.S. Department of Labor found they weren't getting properly paid for overtime.

Royal Oak-based Super Car Wash Systems and Holdings doled out $83,741 in back wages and damages to 60 current and former employees following an investigation by the department's Wage and Hour Division, according to a Thursday department press release.

Super Car Wash violated the Fair Labor Standards Act by paying straight-time rates in cash instead of time-and-one-half rates when employees worked more than 40 hours in one week, according to the release.

New Overtime Rule Hitting Some Employers Harder Than Others

A significant update to federal overtime pay eligibility takes effect this week, and while it's drawn little fanfare from corporations, lawyers say the change is creating compliance headaches for other workforce sectors.

Starting Jan. 1, the Labor Department will begin enforcing an annual salary threshold of $35,568, below which workers qualify for the time-and-a-half overtime premium when they work over 40 hours in a week. That represents a boost from the previous salary cutoff of $23,660, in place since 2004.
