Home health aides in Colorado who work in private residences are not entitled to overtime pay under state law, a U.S. appeals court ruled Wednesday .
The ruling comes from the 10th U.S. Circuit Court of Appeals, which was reviewing a legal against against Maxim Healthcare Services Inc., a privately held medical staffing company based in Columbia, Maryland. As part of its business mix, Maxim offers both home health and behavioral health services, in addition to health care staffing and personal care services.

Lids Retail Managers Secure $1.2 Million Overtime Pay Deal
A $1.2 million settlement between Lids and nearly 700 retail managers nationwide who sought unpaid overtime under the Fair Labor Standards Act received final approval from an Indiana federal court, after the managers addressed deficiencies in certifying the collective action.
The workers have now shown that the members were similarly situated, making final certification appropriate, Judge Sarah Evans Barker of the U.S. District Court for the Southern District of Indiana said Wednesday.

More salaried restaurant employees in Colorado could be eligible for overtime pay under new regulations that were issued Wednesday by the state's Department of Labor and Employment.
The updated rules also mandate that hourly employees be granted 10 minutes of rest time for every four hours or a fraction of that time block that they work. A 30-minute meal break is mandated for any shift lasting at least five hours.

The parties have agreed on a settlement of the action and have requested that the Court give approval to their deal. The settlement will apply to 96 opt-in plaintiffs and a certified class of more than 1,275 portable-toilet service technicians. Under the settlement, the company will put $7.14 million into a settlement fund for payments to the workers, their attorney fees, service awards and administrative costs. The lawyers will ask for one-third of the settlement fund for their fees.

BOSTON (CBS) — Twenty-two Massachusetts State Police troopers could be fired for their involvement in the Troop E overtime pay scandal . Forty-six troopers in all were accused of timesheet “irregularities,” an accusation sparked by an internal audit in 2018 that led to the elimination of Troop E.
Mass. State Police Colonel Christopher Mason announced Friday that the first part of the disciplinary process was completed.
Ten troopers were criminally charged in state and federal courts with accepting pay for overtime shifts they did not work. Of the remaining 36, 14 troopers had already retired. The state retirement board was notified about both groups.
Pennsylvania Commission Approves New Rules Extending Overtime Pay for Thousands of Workers
Pennsylvania Governor Tom Wolf praised the state's Independent Regulatory Commission (IRRC) for approving the Depart of Labor & Industry's new overtime rules that are beneficial to workers.
According to Gov. Wolf, the new rules will extend overtime pay eligibility to additional 82,000 workers.
Under the new rules, full-time salaried workers in executive, administrative, and professional jobs making less than $45,500 by 2020 are eligible for overtime pay. The increase will be phased in over three steps"
