(The Center Square) – Louisiana lawmakers have voted to exclude any COVID-19 relief from state income taxes outside of unemployment benefits.

Only unemployment benefits, which the federal government has enhanced during the pandemic, are excluded.

Biden plans retroactive hike in capital-gains taxes, so it may be already too late for investors

President Joe Biden's proposed budget for the upcoming fiscal year assumes that a hike in the capital-gains tax rate took effect in late April, meaning that it already would be too late for high-income investors to realize gains at lower tax rates, according to a Wall Street Journal report out Thursday citing people familiar with the proposal.

Biden plans to increase the top tax rate on capital gains to 43.4% from 23.8% for households with income over $1 million, though Congress must OK any hikes and retroactive effective dates, the report added.

You also don't want to learn later that you cannot deduct a big payment of proceeds to the funder, or somehow offset it against income from the transaction that generated the proceeds. A prepaid forward contract may involve the sale of stock or other assets. It may involve the assignment of some or all of a lawsuit claim or its proceeds. Many fact patterns are possible with stock sales or litigation finance. But the tax issues are nuanced and can be confusing.

Money changes hands, but there should be no immediate taxable event to the seller if the future sale involves a variable amount of proceeds. Until the closing, it is impossible to determine how the advance payments should be reported. The key IRS tax authority is Revenue Ruling 2003-7, 2003-5 IRB 1, where the IRS approved open transaction treatment for a variable prepaid forward contract involving the sale of stock.

Takeaways from Biden's budget: record debt, looming fight on taxes

The budget projects the federal debt would increase, relative to the size of the economy, to a higher level than during World War II.

During the World War II era, debt peaked at 106% of gross domestic product in 1946. Under Biden's plan, debt is projected to rise to 117% of the size of the economy by 2031. Without changes, it's expected to grow to 113% of GDP.

Battle continues regarding where remote workers pay taxes

The right of cities to tax remote employees during the pandemic continues to face opposition on multiple fronts.

A bill that would allow remote workers to pay income tax to their home municipalities rather than where their employers are located and seek refunds for 2021 taxes passed the Ohio House, Wednesday, May 26.

The nonprofit, right-leaning legal organization announced Thursday, May 27, that its attorneys had filed an appeal with Ohio's Tenth District Court of Appeals in Buckeye v. Kilgore, a case filed against the city auditor of Columbus for collecting taxes from a remote worker in 2020.

Happily accounting for No. 11: Cowboys continue academic dynasty

There was no trip to Austin this year for the juggernaut that is the Happy High School accounting team, but the result was the same – another University Interscholastic League State Class 1A title – No. 11 under accounting coach Sara Reinart.

While athletic dynasties tend to get more notice, Happy has built a formidable program since Reinart began the program winning the district every year since 2005 and the state title every year since 2008 except for 2013 when they placed second and 2014 when they finished third in the region, and of course 2020, when no contest was held due to the COVID 19 pandemic.

Virgin Galactic Sued by Investor Over SPAC's Accounting Issues

(Bloomberg) -- Virgin Galactic Holdings Inc. was sued by an investor who claims he lost money when the space-tourism company announced that it would restate its results due to regulatory guidance about the accounting treatment of warrants.

The Las Cruces, New Mexico-based company said on April 30 that it would have to restate its 2020 results because of accounting guidance of regulators related to special purpose acquisition companies, or SPACs. The next trading day, its shares fell 9%. The company combined with Social Capital Hedosophia, run by former Facebook executive Chamath Palihapitiya, and went public in October 2019.

USG Accounting Office Faults Defense Dept.

The Government Accounting Office (GAO) has issued a 51-page report examining the challenges the Department of Defense faces in developing and fielding new positioning, navigation and timing (PNT) technologies to complement, augment or replace GPS when it is unavailable. It found that the DOD is not doing enough in this regard.

“Officials from across DOD and experts told GAO that alternative PNT solutions are not prioritized within DOD. For example, there is no central program office responsible for developing the variety of alternative PNT technologies across DOD. DOD's continued reliance on GPS, despite known GPS vulnerabilities to disruption, presents a challenge for obtaining sufficient support to develop viable alternatives.”

A nationwide moratorium on evictions spared millions of people struggling to pay their bills, but the same didn't happen for utilities. many companies allowed a grace period for people struggling to pay their bills. But that's mostly ended. Now hundreds of thousands of Floridians have had their power shut off, and money earmarked for residential relief hasn't been able to help everyone.

More than 2,600 Tallahassee residents have had their power shut off since April. To try and help people keep or restore their power local governments have been using federal relief money to pay residents' past due balance. James Barnes, the city's chief customer officer, explains.

Apparently Money Really Does Grow On Trees!

Distortions from March's helicopter money drop continue to cloud the forecast horizon. In nominal terms, income fell -13% M/M in April. This shouldn't have been a surprise given that the free money raised March's nominal income by 21%! Another distortion appeared in core PCE (Personal Consumption Expenditure) prices (the price index most watched by the Fed). It rose +0.7% in April, mainly on the back of reopening (rising prices of air fares, hotels, used cars).

April's nominal growth rate in consumption was +0.5% M/M, but when rising prices are factored, in real terms, consumption fell -0.1%. Here's the kicker – something we've discussed in several prior blogs: services spending did rise +0.6% (actually a disappointment given reopening), but spending on goods fell -1.3%, i.e., the start of our pent-down demand hypothesis.

Danville treasury staff helps residents find missing money | Govt. and Politics | godanriver.com

The Danville's treasurer's office, along with the Virginia Department of the Treasury, is bringing another unclaimed property virtual call event this week to help residents who might be owed funds they don't know about.

Customers can call 1-833-302-0704 from 10 a.m. to 4 p.m. on Thursday and Friday to have staff check their name for missing money.

During the last event held in December, Treasury workers looked up more than 1,000 names over a two-day period. They found $80,690.

Virginia Enacts New Overtime Wage Law | FordHarrison - JDSupra

On March 30, 2021, Governor Ralph Northam signed into law the Virginia Overtime Wage Act (VOWA), creating new wage and hour requirements for Virginia employers. Set to take effect July 1, 2021, the VOWA also includes numerous employee protections. The VOWA amends the Virginia Code to authorize collective actions and allows for a lengthier statute of limitations period and increased damages provisions.

Until now, Virginia did not have its own overtime pay statute. Instead, Virginia employees relied on the federal Fair Labor Standards Act (FLSA) to govern their wage and hour requirements. The FLSA requires that most employees in the United States be paid at least the federal minimum wage for all hours worked and overtime pay at not less than time and one-half the regular rate of pay for all hours worked over 40 hours in a workweek.

City of Eaton settles with Fire and EMS employees - Register Herald

EATON — Eaton City Council passed a resolution authorizing City Manager Brad Collins to execute a settlement agreement relating to overtime pay for City of Eaton Fire and EMS employees during their Monday, May 17 meeting. Councilmember Gary Wagner was not present.

According to court documents filed in the United States District Court Southern District of Ohio, Western Division, plaintiffs in the case alleged the City of Eaton violated the Fair Labor Standards Act (FLSA) by not providing time and one-half overtime pay for hours worked in excess of 212 hours in a 28-day work period or in excess of 40 hours per workweek.

Perry Roofing fined $31,673 for employee pay violations

Perry Roofing of Gainesville has had to pay $31,673 in back wages for 30 workers after an investigation found the company violated federal law, the U.S. Department of Labor reported Thursday.

The company, owned by state Sen. Keith Perry, violated overtime and recordkeeping requirements regarding workers recruited from Gainesville's Santa Fe Bridge Community Work Release Center.

"Perry Roofing failed to include production-related and profit-sharing bonuses in the calculation when determining workers' overtime rates," the release states. "By doing so, the employer paid workers less for their overtime hours than the law requires. Perry also failed to record start and stop times for workers paid by piece-rate."
