Medical Examiner Carolyn Revercomb made $251,633. Revercomb came to Onondaga County in 2019 from New Jersey. At the time, county legislators had increased the salary from $190,000 to make the job more attractive.

Overtime pay exemption can apply to prisoner transport workers, 5th Circuit rules | Reuters

A U.S. appeals court has ruled that an exemption from overtime pay requirements for transportation workers can extend to private prisoner transportation companies, even though they are regulated under a separate federal law.

A unanimous three-judge panel of the 5th U.S. Circuit Court of Appeals on Monday said the attorney general's power to regulate private prisoner transportation firm U.S. Corrections LLC (USC) does not preclude it from claiming the exemption in the Fair Labor Standards Act, which applies to employers overseen by the U.S. Department of Transportation.

Different Takes on Farmworkers, Overtime Law

OMAHA (DTN) -- As Democrats in Congress look to line up provisions of the infrastructure package and a family relief plan, a House Education & Labor Subcommittee held a hearing Monday concentrated heavily on expanding overtime wages for farmworkers.

The hearing highlighted overtime exclusions in the Fair Labor Standards Act (FLSA), going back to 1938, that Democratic witnesses said were policies meant to affect people of color. Monday's hearing focused on farmworkers, domestic workers and restaurant workers who rely on tips.

Councilors struggle to rein in police overtime - The Bay State Banner

Last year, when former Mayor Martin Walsh pledged to cut police overtime by 20%, police reform activists pointed out that the department routinely overspends its overtime budget.

True to form, by February, the department blew past the $48 million the Walsh administration claimed it would spend on overtime in the 2021 fiscal year, which ends June 30. In the last year, more than 30 officers earned over $300,000, based mostly on overtime and paid details, the Boston Globe reported last week.

Biden administration withdraws Trump-era independent contractor rule, raising more questions

The Labor Department is rescinding a rule that made it harder for gig and contract workers to argue they were entitled to minimum wage and overtime protections, part of a push to undo Trump-era decisions that favored businesses and employers.

Companies have increased the use of contractors in recent decades in part to lower labor costs. Employees are entitled to a range of benefits not afforded to contractors, including a minimum wage and overtime pay.

Prison Transport Driver Gets Second Shot to Prove Overtime Claim

An overtime-pay claim by a driver who worked for a private employer transporting prisoners was improperly dismissed at the pleading stage of the proceedings, the Fifth Circuit said.

The Motor Carrier Act's exemption from overtime-pay under the Fair Labor Standards Act for employees who work for private motor carriers subject to Department of Transportation regulations may apply to Dana White's claim, the opinion by Judge Cory T. Wilson said. But whether the exemption precludes her claim is a question of fact that should be decided on a motion for summary judgment, it said.

State officials and labor organizers are bolstering their efforts to stop wage theft, thanks to new laws that strengthen protections for Virginia workers.

The Virginia Interfaith Center recently launched wagetheftva.org , a website designed to educate workers about their rights and connect them with resources. Additionally, Attorney General Mark Herring announced the launch of a new worker protection unit in March, led by criminal prosecutor Ayesha Meekins.

Workers at a Maine Dollar General quit with a splash, ‘speak truth to power’ | Beacon

Three workers at the Dollar General in Eliot, Maine decided this week that they had had enough. They walked off the job together, leaving the store with only one employee. But before they locked up after their last shift on Monday, they tendered their resignations and taped them to the glass door.

Cashier Berndt Erikson, 27, of Kittery drafted the signs with the help of co-worker, who they identified as Hannah. Erikson then posted a photo of their signs on Twitter. "Got real tired of all those 'no one wants to work' signs on closing stores," they wrote. "This is how my coworker and I quit our job today. Speak truth to power!"
