Erie County Comptroller Stefan Mychajliw is questioning the work records of top administrators in the Poloncarz administration who have claimed a high amount of overtime.
The Erie County Comptroller's Office has reviewed the calendars and electronic time sheet records for Health Commissioner Dr. Gale Burstein and Emergency Services Commissioner Daniel Neaverth Jr. and raised some questions about unaccounted work time.
Both Neaverth and Burstein turned over their calendar and electronic time sheet information for scrutiny by the county Legislature.
Department of Labor Issues Two New Wage and Hour Rules - Lexology
Two new rules issued by the U.S. Department of Labor (DOL) could bring changes for employers who use the retail sales exemption or the fluctuating workweek compensation method. The retail sales rule withdraws outdated lists, streamlining the analysis to determine eligibility for exemption from overtime compensation. The fluctuating workweek rule permits bonus payments for employees who are paid overtime compensation based on that method.

The first new rule, effective May 19, simplifies the exemption from overtime compensation for certain commissioned employees of retail or service establishments. It sheds light on whether certain businesses are considered retail or service establishments for purposes of that exemption.

BUFFALO, N.Y. — Following a previously released report regarding overtime payments to county employees not normally eligible for such compensation, the Erie County Comptroller is out with another report on overtime paid to unionized county workers during the pandemic.
The county is using federal COVID-19 relief funds to pay those costs.But this report is also stirring up controversy between two familiar political foes.
This more than 40-page report from the office of County Comptroller Stefan Mychajliw shows that since the state emergency was declared in mid-March, more than $2.3 million in overtime has been paid to more than 700 union workers in the county.

Some Erie County Employees Receive Thousands in Overtime Pay
A new report released by the Erie County comptroller shows dozens of high level county employees received thousands and, in some cases, tens of thousands of dollars in overtime pay for work related to the coronavirus pandemic.
Comptroller Stefan Mychajliw compiled COVID-19-related overtime accrued by 54 Managerial Confidential employees, non-union staff who are hired and serve at the pleasure of an elected official, and found the county paid out $825,000 over an 18-week period this year.

Bikini Beans Coffee, a local chain of coffee stands staffed by bikini-wearing baristas, is being sued in federal court by two former workers who allege that the company failed to properly pay employees.
The class-action lawsuit was filed on July 30 in the U.S. District Court of Arizona by Valerie Valle and Keely Siegel, on behalf of current and former Bikini Beans employees. The two women worked at Bikini Beans locations around metro Phoenix, Valle as a former manager, and Siegel as a former barista. They're being represented by Bendau & Bendau PLLC.
